Despite significant industry and union push back, the DC US Court of Appeals this morning upheld the vast majority of OSHA’s new Construction Silica Standard.
The main challenges were:
- Whether or not OSHA’s reduced silica exposure limits would reduce worker health risks
- If the new standard requirements were technically and economically feasible
- If OSHA violated the Administrative Procedure Act
The court rejected these and other objections to uphold the new standard.
