Industrial wastewater
Pretreatment permits, discharge monitoring, and reporting to your local wastewater authority
Hazardous waste management
Waste determinations, generator status, labeling, manifests, transportation, and disposal
Chemical reporting: Tier II and TRI
Tier II chemical inventory reports and Toxics Release Inventory (TRI) reporting
Spill prevention

The Most Common Environmental Violations in Texas

In our experience, these are the gaps we find most often at small Texas manufacturers:

Stormwater
Many manufacturers need stormwater permit coverage based on their industry classification and don't know it. The core requirement is a stormwater pollution prevention plan, plus training, inspections, and sampling.
Hazardous waste
Failing to determine generator status, label containers properly, or complete waste determinations for every industrial waste stream.
Air permitting
Failing to claim and document the right TCEQ permits by rule. Common activities like surface coating and painting often need one, and exceeding their limits can mean a full air permit.
Chemical reporting
Missing annual Tier II and TRI reports, which are triggered by the amount of certain chemicals you store or use.

Find Problems Before TCEQ Does

The Texas Environmental, Health, and Safety Audit Privilege Act encourages companies to find and fix their own violations. Companies that follow its requirements, including giving notice before the audit, disclosing the violations they find, and correcting them within a reasonable time, can qualify for immunity from administrative and civil penalties for those violations. Immunity does not apply in every case, such as violations that were intentional or caused serious harm. Berg has helped Texas manufacturers work through this process, from the audit to every corrective action.

Berg Compliance Solutions: Environmental Compliance Built for Texas Manufacturers

Why Texas Manufacturers Choose Berg for Environmental Compliance

Russell Carr, Founder and CEO

"I started in this business in 2003, handling hazardous waste for Texas manufacturers. Over the years, I've watched good companies get hit with TCEQ penalties for things they didn't even know applied to them: a missing waste determination, an outdated stormwater plan, a paint booth installed without checking the air rules. None of them were trying to cut corners. They just didn't have anyone who understood the rules.

That's what we fix. We find out exactly what applies to your plant, get you compliant, and keep you that way."

Texas Environmental Compliance FAQ

What does an environmental compliance consultant do?

An environmental compliance consultant helps you understand which TCEQ and EPA rules apply to your facility, get compliant, and stay that way. That includes air authorizations, stormwater and wastewater permits, hazardous waste management, chemical reporting, spill plans, audits, and training.

Does my facility need an air permit?

Most facilities with air emissions need some form of TCEQ authorization. Many small sources qualify for a permit by rule or a standard permit rather than a full permit. Areas that do not meet federal ozone standards, such as Houston and Dallas-Fort Worth, can have stricter rules.

Do we need a stormwater permit?

Facilities in many industrial categories need coverage under the TPDES Multi-Sector General Permit, or a no-exposure certification if no industrial materials or activities are exposed to rain. The answer depends on your industry classification and what happens outdoors at your site.

How do I know if a waste is hazardous?

Each waste stream needs a waste determination based on its source, its contents, and federal and Texas rules. In Texas, industrial wastes also need to be classified and coded. We complete and document these determinations so your waste is labeled, stored, and disposed of correctly.

What is hazardous waste generator status?

Your generator status (very small, small, or large quantity generator) depends on how much hazardous waste you generate each month. Each status comes with different rules for storage time, labeling, training, and emergency planning, and it can change as production changes.

What is Tier II reporting?

Facilities that store hazardous chemicals above federal threshold quantities must file a Tier II chemical inventory report each year by March 1. The report lists what you store, how much, and where, for use by emergency responders.

What is the Texas Audit Privilege Act?

It is a Texas law that encourages companies to audit themselves. Companies that give notice before the audit, disclose the violations they find, and correct them within a reasonable time can qualify for immunity from administrative and civil penalties for those violations. Immunity does not apply in every case, such as violations that were intentional or caused serious harm.

We received a TCEQ Notice of Violation. Can you help?

Yes. We help you review the notice, correct each item, document the fixes, and communicate with the regional office, then put systems in place so the same issues don't come back. If TCEQ is involved right now, call 888-784-1405.

Can you train our safety person to manage environmental compliance?

Yes. We can train your safety person to manage your TCEQ and EPA compliance, with an experienced Berg consultant checking their work, or Berg's environmental consultants can handle it for you. Either way, everything is tracked in Enviro-Trac.

How much does environmental consulting cost?

It depends on your facility and the help you need. Berg offers a free consultation, and pricing depends on whether you need a one-time project or ongoing support. After a short call, we'll give you a clear number.
